Walter and Helen Kindler Emails to the OAG

Walter and Helen Kindler are Complainants who corresponded by email with the Indiana Office of the Attorney General (OAG) during the investigation and litigation.  They have lived at The Harbours for a number of years, and Walter has made a number kindler pic 2of unsuccessful attempts to get elected to the Harbours Board of Directors.  He briefly served on the Board by appointment between June and December of 2009.  His most recent unsuccessful attempt to gain a seat on the Board was the last election for Board terms commencing in 2017.  Results of that election were detailed in a December 2016 posting to this site.

As longtime Harbours residents, the Kindlers were involved in a number of old issues, most of which didn’t make it into the AG lawsuit explicitly.  Their emails mention and discuss those matters in detail.  In the context of the suit, it’s therefore not really necessary to understand most of their issues.  For anyone who has an interest, the balance of this blog entry responds to them.


Walter Kindler’s emails to the OAG have been organized into four threads linked in the file below.  These emails contain additional links to subjects that Mr. Kindler referenced.

The emails are numbered 001-4 but presented as before in reverse chronological order; to understand them chronologically, read from the bottom up.  Kindler’s earliest email (004) was in August 2010 immediately following a meeting between OAG staff members and Complainants.  In the next email chronologically (003), there are external links.  Kindler references the “campaign” letter sent to homeowners that the OAG attached to the Complaint as Exhibit MM.  The MM links are relabeled here and in email 003 as LINK 1 pp. 11-12 and LINK 2.  (The first ten pages of LINK 1 are unrelated.)

Mr. Kindler complains that his own campaign for election was negatively impacted, presumably meaning that one of his many unsuccessful Malcontent Family Picture-no ovalcampaign runs was in the 2011 election for the 2012 Board.  Walter and Helen Kindler both appear in the LINK 2 photo.

In response to Walter’s remarks, a Word file was composed at that time and embedded now in email 003 as PDF LINK.  The responses in this PDF file are pretty self-explanatory.

At the top of email 003 is the complete VIDEO LINK involving Complainant Betty Haley and a former Harbours employee, information that was previously discussed in the posting “Complainants’ Legal Counsel“.  This security video file was uploaded in its entirety to a public domain website because Haley’s attorney only released an adulterated copy while defending his client.  As of this writing, Haley’s criminal cases are still pending in Clark County, IN Circuit Court.

Ms. Kindler’s focus was similarly on pending criminal matters and how they were reported by the Chair of the Harbours Legal Committee at that time.  She linked photos of a Harbours computer that contained images to which she took objection.  Those links are shown here and in email 001:

Helen Kindler didn’t mention to the OAG that these images were in response to another photo-shopped image that was previously displayed on the same computer by Complainant Marty Haley:

The Kindlers submitted individually linked complaints that were previously discussed: LINK 1, LINK 2.  None of their complaints and email issues were pursued by the OAG with the exception of the campaign letter which was appended to the lawsuit.  And there was no follow-up action to the letter taken by the OAG in their settlement terms.  The Kindlers were unhappy with various things at The Harbours, but evidently, they couldn’t get the OAG to agree that their issues had much (or any) merit.
